(PAN:-----------;Aadhaar No.--------) wife of Mr.---------, Hindu, aged about -- years, both are residing at No.--/--, ----- Flats, -st Floor, -------- Road, --------, ------------, hereinafter jointly called as the "PURCHASERS" which expression shall mean and include themselves their heirs, successors, executors, administrators, legal representatives, attorneys and assigns of the OTHER PART.

WHEREAS the land measuring an extent of -- Acre, comprised in Survey No.---, situated at ---------- Village, -------- Taluk, --------- District belongs to one Mr.---------, son of Mr.----------, he purchased the same from Mr.---------, vide; Deed of Sale dated --/--/---- registered as Document No.-- of 19-- SRO:---------.

 

AND WHEREAS another portion of agricultural punja land measuring an extent of -- Acre -- Cents, comprised in Survey No.----/--, situated at ------ Village,  belongs to Mr.------------, son of Mr.----------, he purchased the same from Mr.-----------, vide; Deed of Sale dated --/--/----  registered as Document No.-- of 19-- SRO: ----------.

 

AND WHEREAS aforesaid Mr.------------, who died intestate on --/--/----, leaving behind -----------, as his only surviving legal heir to succeed his estate was evidenced from the Legal heir ship Certificate No.---/--/Ee dated --/--/----  issued by the Thasildhar, ----------.

 

AND WHEREAS aforesaid Mr.------------, by succession entered into the shoes as a legal heir and becomes the absolute owner and in possession of the land measuring an extent of --- acre -- Cents, in Survey No.--- /--, situated at ------ Village, and out of love and affection towards his first daughter Mrs.---------, settled the land measuring an extent of --- acre ---- Cents, in Survey No.--- / --, situated at ----- village, absolutely with all power of alienation  vide; Deed of Settlement dated --/--/---- registered as Document No.---- of 20-- SRO:----------.

 

 

 

 

AND WHEREAS aforesaid Mr.---------, who died intestate on -------- leaving behind his wife------------, daughters--------,---------,---------, sons -------. -------- & ----------as his surviving legal heir to succeed his estate was evidenced from the Legal heir ship Certificate No.Pa.Mu.--- /20--,  dated --/--/---- issued by the Thasildhar, ---------.

 

AND WHEREAS later on the legal heirs of Mr.------------, his wife ---------, daughters ------- & ---------, sons ---------, ------- & ----------, gave their acceptance to Mrs.-------, for the previous Deed of Settlement dated --/--/---- given by Mr.---------, by the Deed Acceptance dated --/--/---- registered as Document No.----- of 20-- SRO: ------.

 

 AND WHEREAS Joint Patta No.--- dated  --/--/---- stands in the name of

1) Mr.--------, 2) Mr.---------, sons of Mr.----------- & 3) Mrs.---------, wife of Mr.-------- & daughter of Mr.---------, for an extent of -- acre --- Cents, as per patta sub division Survey No.--- /---  issued by Zonal Deputy Thasildhar, ------.

 

AND WHEREAS subsequently the aforesaid Mrs.-------, daughter of Mr.-------, out of love and affection towards her brother Mr.---------, settled land measuring an extent of --- acre --- Cents, in Old Survey No.--- /--, as per Patta No.---- New Survey No.---- /-----, situated at ----- Village, absolutely with all power of alienation and retained the remaining portion of ---- Acres or thereabouts with her; vide; Deed of Settlement dated --/--/---- registered as Document No.---- of 20-- SRO:----------.

 

AND WHEREAS Patta No.---- dated --/--/---- stands in the name of Mr.---------, son of Mr.----------, for an extent of - acre -- Cents, as per Patta sub division Survey No.--- /------  issued by Zonal Deputy Thasildhar, -------.

 

AND WHEREAS aforesaid Mr.--------, son of Mr.------------, sold the land measuring an extent of -- acre --- Cents, in Old Survey No.----/-, as per Patta No.----, New Survey No.---/-------, situated at ------ Village, in favour of M/s.-------- Estates rep by its owner Dr.------------, son of Mr.-----------, vide; Deed of Sale dated --/--/---- registered as Document No.------ of 20-- SRO: --------.

 

AND WHEREAS aforesaid Dr.--------, the vendor herein is in possession and enjoyment as absolute and exclusive owner of the aforesaid land and mutated Patta No.----, dated --/--/---- in his name issued by Zonal Deputy Thasildhar, -----------.

 

AND WHEREAS aforesaid ----------, for the purpose of conversion of land into layout and the same was approved by the Commissioner, Directorate of Town and Planning, ----------- vide;DTCP No.--- /20--;File No.---- /20--,dated --/--/---- and gifted the land for Roads and Parks as per the specifications in the approved lay out plan  to and in favour of The Panchayath President, -------- Village Panchayath, vide; Deed of Gift dated --/--/---- registered as Document No.------ of 20-- SRO: ------- and named the layout as “----- Dream City”.

 

AND WHEREAS  the vendor is the sole, absolute and exclusive owner and in possession of Plots Nos.-- to -- measuring an extent of -------- sq.ft., and shop site bearing Shop No.-- measuring ----- sq.ft.,   

 WHEREAS the VENDOR has absolute right and clear & marketable title to the Vacant Plot bearing No.-=, measuring  an extent of ----- sq.ft., and Vacant Plot bearing No.--, measuring  an extent of ---- sq.ft., the SCHEDULE PROPERTY and the VENDOR has offered to sell and transfer the SCHEDULE PROPERTY to the PURCHASERS for a sale consideration of Rs.--------------/- (Rupees -------------- only) and the PURCHASERS has agreed to it on the following terms and conditions:

 

NOW THIS DEED OF SALE WITNESSETH that in pursuance of the aforesaid agreement and in consideration of the premises and the payment of a sum of Rs.-----------------------/- (Rupees ------------ only) paid by the PURCHASERS to the VENDOR as follows: 1)Rs.----------/- by way of Cheque No.---------- dated --/--/----, drawn on ------- Bank, 2) Rs.---------/- by way of Cheque No.--------- dated --/--/----, drawn on ------ Bank,3) Rs.----------/- by way of Cheque No. ---- dated  --/--/---- and  4) Rs.------------/- by way of Demand Draft bearing No.--- dated --/--/----, drawn on --- bank in favour of the vendor’s agent the receipt of which total sum of Rs.-----------/- being entire sale consideration the VENDOR do hereby acknowledge, admit and acquit the PURCHASERS from any further payment, the VENDOR do hereby grant, convey, and  assign by way of absolute sale unto the PURCHASERS all that piece and parcel of  Vacant Plot bearing No.--, measuring  an extent of ----- sq.ft., and Vacant Plot bearing No.--, measuring  an extent of ------- sq.ft., more fully described in the SCHEDULE PROPERTY hereto, together with all the ditches, messuages, water, water courses, privileges and appurtenances, whatsoever to the said SCHEDULE PROPERTY or any part thereof or  belonging to or known as part and parcel  thereof or appurtenant thereto and all the estate, right, title and interest whatsoever of the VENDOR  in unto the said properties TO HAVE AND TO HOLD the said SCHEDULE PROPERTY hereby granted, conveyed, and assigned, or expressed so to be unto the PURCHASERS absolutely forever and free from all encumbrances and forever. 

 

AND THE VENDOR do hereby covenant with the PURCHASERS that notwithstanding anything by the VENDOR omitted or knowingly suffered the said VENDOR have full power and the sole and absolute right to grant, convey, and  assign the said property to the use of the PURCHASERS and the said SCHEDULE PROPERTY may be entered into held and enjoyed by the said PURCHASERS without any hindrance, interruption, claim or demand from or by the VENDOR or any person claiming through or in trust for the VENDOR or their predecessors-in-title.

 

AND THE VENDOR also covenant that the VENDOR and every person claiming through or in trust for the VENDOR or his Predecessors-in-title at all times at the request and cost of the PURCHASERS do all such further acts and things as may be necessary and required for further assuring the title and peaceful possession of the SCHEDULE PROPERTY to the use of the PURCHASERS.

 

AND THE VENDOR also covenant that the VENDOR had not charged, mortgaged, leased out or otherwise encumbered the said SCHEDULE PROPERTY or subjected it to any claim or demand.

 

AND THE VENDOR also covenant that the VENDOR will at all times indemnify and keep indemnified the PURCHASERS against all losses, damages, claims, expenses, liabilities, whatsoever which they may be put to or sustain by reason of any defect in title or dispute that may be put forward or raised by anybody touching the said SCHEDULE PROPERTY.

 

 

AND WHEREAS the VENDOR doth hereby covenant that the SCHEDULE PROPERTY is within the ceiling limits under relevant land reforms enactments and further declares there are no land acquisition proceedings or proposed land acquisition proceedings by the State or Central Government.

 

The VENDOR confirms that no portion of the SCHEDULE PROPERTY had been used by any person as a path way or for gaining access or for the purpose of having ingress and egress to any other property or roads etc.

 

The VENDOR hereby declare that he had paid all the taxes, Kists and other public outgoing in respect of the SCHEDULE PROPERTY to the concerned authorities up to this date in full and undertake to pay the same, if anything is found unpaid up to this date.

 

AND WHEREAS the VENDOR further covenants that he had no objection for mutating the revenue records in favour of the PURCHASERS in respect of the SCHEDULE PROPERTY hereby conveyed.

 

 The  VENDOR further covenants that they had this day handed over the copies of the original title deeds to the PURCHASERS and put the PURCHASERS in physical and vacant possession of SCHEDULE PROPERTY and the PURCHASERS confirm having taken possession.
