1.     I am advocate in record in this case and I know the facts of  the case.

2.     The above mentioned case was posted on ---- for arguments. Petitioner’s advocate informed us that since he was not doing well, he shall get an adjournment. Only if the petitioner side argument is over, respondents can argue their side defence.

3.     Only for this reason this 2^nd respondent didn’t argue on ----. But the case was posted to orders without hearing our side arguments.

4.     Since this is a heavy value claim and there are various issues like policy violation and disputed vehicle insured with two insurance companies, our defences has to be explained to hon’ble court.

5.     Hence this case has to be re- opened and the hearing may be advanced from ----  to earlier date.

It is therefore just and necessary that this hon’ble court may be pleased to advance the hearing of the case  which is posted for orders on ----- to earlier date and post it for arguments and thus render justice.
