CLASSIFICATION OF EVIDENCE
Primarily according to the definition
of “evidence”as given in section 3 of The Indian evidence act, the statute, evidence is of
two kinds. Ie. The oral evidence and the documentary evidence. Oral evidence
can be divided into two, namely, evidence given by eye witness and herarsay
evidence.
Based on the nature of evidence found in various provisions of Indian evidence
act, evidence may be classified as under.
1. Direct and circumstantial
evidence.
2. Real and personal
evidence.
3. Original and unoriginal
evidence / primary and secondary evidence.
4. Substantive and non –
substantive, and
5. Positive and negative.
