AFFIDAVIT

                                    I, ----- ,s/o -----, religion, aged  --  years, occupied as – designation--- in     --name of the institution--  do solemnly makes oath and states as follows:
1.     I am – designation-- in the  petitioner/2nd respondent organisation and I know the facts of the case.
2.      The above mentioned case was posted on --- for appearance of petitioner/ 2nd respondent.  Since we did not receive any communication from -- branch office in time, we could not not appear before the court on that day. Hence exparte order has been passed against this petitioner/2nd respondent .  Non appearance before the court on that day is neither willful nor wanton and beyond the control of the petitioner/2nd respondent.
3.     Now this 2nd respondent files vakalath . Hence the exparte order passed on --- has to be set aside and this hon’ble court may be pleased to receive vakalath.
4.     Unless exparte order passed on ---- is not set aside and vakalath is received this petitioner/2nd respondent insurance company will be put to irreparable loss and much hardship.                                                                  
     It is therefore just and necessary that this hon’ble court may be graciously pleased to set aside the exparte order passed against petitioner/2nd respondent on ---- and receive the vakalath regarding the above mentioned case  and thus render justice.
