I, , s/o , religion, aged years and residing at ---------- do solemnly make oath and
states as follows:
1. I am the petitioner
herein. I have filed the main claim petition seeking compensation on account of
the injuries sustained by me in a motor vehicle accident.
2. I HAVE CLAIMED A SUM OF Rs.3,00,000/
towards compensation in the claim petition for which the court fees comes to
Rs.2,372.50. Now I have affixed court fees stamp for Rs.200/ as nominal court fees.
3. My claim petition may
kindly be read as part and parcel of this affidavit for better particulars.
4. I incurred lot of expenses
during the treatment. Hence I am unable to pay court fees now.
5. Under the above
circumstances, I am not in possession of liquid cash amount to pay court fees
as prescribed under the rules. I undertake to pay the court fees at the time of
getting a decree under rule 24(1) of claims tribunal rules.
6. Unless this hon’ble court
exempts from payment of court fees under rule 24(3) I will be put to great loss
and hardship. The exemption of payment of court fee now and
to pay court fee prior to getting the decree copy will not prejudice the other
side.
Therefore it is just
and necessary that this honourable court
may be pleased to exempt me from payment of court fees of Rs.2,172.50/ and thus
render justice.
