MODEL FORMAT OF GENERAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS by this Deed of General Power of Attorney executed at ____________ (Place) on this _________________________(Date, Month and Year) by Mr -------------, son of Late. Mr. ---------, --religion--, aged -- years and residing at Building--, NO.------, street name, name of city, Name of the country, hereinafter called the “PRINCIPAL” do hereby nominate, appoint, ordain and retain my brother, Mr. ------, aged --- years,  son of ---------, residing at   ----------;  hereinafter called the “AGENT” as my true and lawful attorney in my name and on my behalf to do all acts, deeds and things in respect of the property mentioned hereunder:

WHEREAS the landed property Viz., one apartment, more particularly described in the Schedule here in under being a land and building at Flat No.---, ------ Floor, with an area of ----- sqft Build Up Area (including Common Area) together with --- Sqft., undivided Share of Land  out of the total extent of  ----- Sqft,  owned by Mr.-------, my father, being Plot No.----, ------- Street, ------- Nagar, ----------- comprised in Survey No. ---, as per PATTA No. ----, New Survey No. ----/--, situated at No.-----, ------- Village, ----Taluk, -------- District was owned by our father Sri.--------.

AND WHEREAS the Schedule  property was owned by our father Sri. ------ who died intestate on --/--/-- (DEATH CERTIFICATE REG.NO. D------------- dt --/--/--) leaving behind me and my brothers i.e.,---- and -------, as his sole and surviving legal heirs vide; LEGAL HEIR CERTIFICATE No. TN------------ dt --/--/-- Our mother, ------, wife of Sri.------ pre-deceased our father on --/--/-- viz., DEATH CERTIFICATE REG. NO. ----------------- dt --/--/-- Thus we all the three brothers had inherited the schedule mentioned property in equal shares.

As I (PRINCIPAL) am temporarily residing at –country name--, and unable to manage the schedule mentioned  property being All that 1/3rd undivided share in  Residential Flat No.---, in the ----- Floor, built up area of  ------ sqft. (Including common area) with One covered Car park, together with an extent ---- sqft,UNDIVIDED SHARE OF LAND, out of  -----  Sqft, in Plot No. ----, ----- Street, -------- Nagar, -----------, comprised in Survey No. -----, as per PATTA No. ----, New Survey No. ------, situated at No.----, ------------,  I thought to fit to act through a lawful attorney and for the said purposes and for other purpose as mentioned herein below do hereby constitute and appoint  my brother, Mr.-------, as my Attorney and on my behalf to do any one or all of the following acts, deeds, and things, namely :-

To negotiate and enter into any M.O.U, Sale Agreements, or other Agreement with Prospective Purchasers of Flat for the purpose of selling on such terms and conditions as my AGENT thinks fit, to modify alter or revoke the same.

1.    To take care of the interest of the PRINCIPAL in respect of the schedule mentioned property and to maintain the same.

2.    To sell and convey the share and whatever interest the PRINCIPAL herein has in the property described in the Schedule hereunder, to any prospective PURCHASER or PURCHASERS and also to enter into agreement with them for that purposes with the due consent and concurrence of the Principal.

3.    To receive advance and sale consideration payable in respect thereof and to give valid receipts and vouchers thereof with due counter signatures of the Principal.

4.    To execute Sale Deed or Deeds for conveyance, conveying the schedule property to the prospective PURCHASER/S and to present such deed or deeds before the concerned Registrar office, admitting execution thereof and to register the same.

5.    To deliver possession of the sold out land on behalf of the PRINCIPAL to the proposed PURCHASER/S for their absolute enjoyment.

6.    To execute Sale deed, Ratification Deed, Rectification Deed, that is necessary as the case may be with the due consent of the Principal.

7.    To sign necessary forms, applications of the statutory and other authorities for mutation of records, for obtaining necessary extracts, Patta etc., to make necessary application for the same, make declarations and produce the same.

8.    To appoint and engage any advocate or advocates to proceed against or to prosecute or to defend anybody in respect of any work that is concerned with the schedule properties owned by the PRINCIPAL herein.

9.    To appear before the concerned Court and to present the petitions, affidavits, suits, proof affidavits or other papers for proper prosecution of the case and to give necessary sworn statements, statements, declarations etc., on behalf of the PRINCIPAL and to file documents etc.

10. To do all other acts and deeds and to execute any form/or application that is necessary for the proper execution of the acts, deeds and powers mentioned herein.

11. Generally, to do all the acts, deeds and things that may be necessary in connection with the said property only.

12. To keep accounts for all amounts received and expenses incurred and produce the same to the PRINCIPAL whenever required.

13. The PRINCIPAL doth hereby declare that no consideration has been passed on to the PRINCIPAL by the AGENT in execution of this Deed of Power of Attorney.

 

14. Any and all controversy(ies) / disputers) / difference(s)/ claim(s) / claim(s) in tort arising out of or in connection with or in relation to this power of attorney, including its existence, validity or termination, shall be referred to and finally resolved by arbitration of Arbitrator(s) nominated by the CNICA, and its Rules shall prevail. The award so rendered shall be final and binding on the parties. The language shall be English and the venue shall be at ---------
