I, , s/o , aged years, Assistant manager, insurance co ltd., having it’s office at --DO--, do hereby solemnly affirm and sincerely state
as follows:-
1. I am an officer of the
petitioner insurance company, divisional office and I know the facts of the case. In the above claim, our insurance
company is the 3rd respondent in the main petition.
2. The petitioners had filed
the claim petition for the grant of compensation on account of the death of --------
in a motor vehicle accident.
3. This hon’ble court awarded
a sum of Rs.-----------/ along with interest and cost on ---------.
Accordingly, the petitioner/2nd respondent herein deposited a sum of
Rs.----------/ into the court.
4. The petitioner/3rd
respondent had filed an appeal in CMA NO /20 on the file of the -------
high court. As per high court directions, the respondents/claimants had already
withdrawn a sum of Rs.
/and the balance amount of Rs.
/ invested in a bank. The appeal is partly allowed. In the said appeal,
the compensation amount is reduced from Rs. / to Rs. /- on --------. The excess amount
shall be refunded to the petitioner / 3rd respondent insurance
company. The petitioner/3rd respondent is entitled to withdraw the
excess amount.
5. To enable the company to
withdraw the excess amount, the amount invested in the bank has to be send for.
Hence this petition.
6. Hence I am filing this
application to send for the invested amount due to the company along with
accrued interest thereon from the bank to civil court deposit so as to enable
the company to withdraw the same. Otherwise, the petitioner/3rd
respondent insurance company will be put to great loss and much hardship.
It is therefore just and necessary that this
hon’ble court may be pleased to send for the invested amount of Rs. / due to my insurance
company along with accrued interest thereon from the bank to civil deposit so
as to enable the petitioner/3rd respondent insurance company to
withdraw the same and thus render justice.
