CUSTODY OF CHILDREN ACROSS
THE WORLD
In matrimonial disputes, custody of
children is yet another dispute between the parents. Both the parents tend to
get to get custody of the children. But the Indian law does not permit that.
They give custody of the children only to either of the spouse and the other is
given right to visit the child in the time and place stipulated by the court.
According to law related to hindus
the custody of the child up to the age of 5 is with the mother. According to
law related to muslims if it is a male child up to the age of 7 and if it is
female, until she attains puberty. In parsis there is no such age limits.
The most affected persons in this
system is, the grandparents of the children. Law does not permit the custody to
be given to grandparents. Nowadays both the parents of the children are
employed, and they are brought up by the grandparents. During matrimonial
disputes, the custody of the child is given to either one of the parents, and
the other is given visiting rights in the stipulated time and the grandparents
are not given any rights.
In foreign countries like USA the
custody is given to both the parents. This is a good system and reforms should
be brought about in india also to bring about such a system by making amendment
in the existing law, so that both the parents of the child will have access to
the child and will be able to fulfill their needs. The child also will have
access to its parents whenever it wants them. Hence it is high time that such
reforms may be brought about.
